In a landmark decision yesterday, the Presidential Election Petitions Court has officially upheld the election victory of President Bola Tinubu, representing the All Progressives Congress (APC), in the highly contested February 25, 2023, presidential election.
The pivotal question of whether the Independent National Electoral Commission (INEC) was justified in declaring Bola Tinubu as the duly elected President, based on the majority of lawful votes cast, has been conclusively settled. The court, in a unanimous verdict, ruled that the petitioners, the Peoples Democratic Party (PDP) and its candidate Atiku Abubakar, failed to substantiate their allegations on this and all other grounds presented in their petition.
Justice Haruna Tsammani, the distinguished leader of the five-member panel, delivered the decisive judgment. He declared, “This petition accordingly lacks merit. I affirm the return of Bola Ahmed Tinubu as the duly elected President of the Federal Republic of Nigeria. The parties are to bear their cost,” sealing President Tinubu’s victory.
In a significant move, the court also removed 37 exhibits presented by the witnesses from the official court records, citing concerns over document dumping. Justice Tsammani clarified that this action would impact the weight assigned to such evidence.
Additionally, the Tribunal addressed the matters of Tinubu’s alleged conviction and dual citizenship, upholding its prior ruling that these issues were beyond its jurisdiction and were therefore struck out.
