Osun APP Clarifies Court Ruling on APC ‘Yes/No’ Chairmen

The Action Peoples Party (APP) in Osun State has maintained that the judgment of the Federal High Court sacking the controversial APC “Yes/No” local government chairmen remains valid and subsisting, despite the dismissal of a contempt application against the officials.

In a statement issued on Tuesday by the party’s Media and Information Unit in Osogbo, the APP said the ruling on the contempt proceedings did not in any way invalidate the earlier court judgment that removed the chairmen from office.

The party stated that the Federal High Court judgment, which sacked the chairmen, was affirmed by the Court of Appeal on January 13, 2025, and June 13, 2025.

“The judgment effectively removed them from office,” the statement said.

The APP explained that the contempt case only suffered what it described as a technical setback after the court held that the APC chairmen were not personally served, despite an application for substituted service.

According to the party, the court merely struck out the names of the chairmen from the contempt proceedings on procedural grounds.

“Striking out their names from the contempt case does not amount to victory for the APC.
The court clearly relied on the earlier judgment of the Federal High Court, which had already sacked them from office,” the statement added.

The APP stressed that the court neither restored the tenure of the chairmen nor granted them any legal authority to continue occupying office.

“At no point did the court extend their tenure or declare that they still have any legal right to remain in office. Rather, the court reaffirmed that they had already been removed,” the statement read.

The party further clarified that the only issue before the court was whether the officials could be committed to prison for contempt under the prevailing circumstances.

It also dismissed suggestions that the ruling could hand any political or legal advantage to the All Progressives Congress (APC) or give the party access to local government funds.

“Therefore, the ruling does not translate into any political or legal victory for the APC, nor does it grant them access to local government funds,” the APP stated.
